Terms of Service

1.1 Service Description

Pathleader provides a digital platform designed to help job seekers find employment opportunities through artificial intelligence (AI) job matching, cover letter generation, AI career counseling, and interview preparation ("Service"). The platform integrates with various job boards and employment services to provide personalized job recommendations based on the User's uploaded CV/resume and career preferences.

1.2 License Grant

Pathleader grants the User a license to use the Service subject to the terms specified in this ToS. By using the Service, the User enters into a legally binding agreement with Pathleader.

1.3 Agreement Acceptance

Pathleader provides the Service in accordance with the terms set forth in this ToS and the Pathleader Privacy Policy. If the User does not accept this ToS, the User is not permitted to use the Service or to access any content provided through the Service.

1.4 Publication

The current version of the ToS and information regarding the Pathleader Privacy Policy are published on the pathleader.ai website.

2.1 Requirements

To be eligible to enter into the ToS and use the Service, the User must:

• be at least 13 years of age (or the minimum digital consent age in your jurisdiction)
• if under 18 years of age, have obtained parental or guardian consent to use the Service
• provide accurate personal information when requested
• for Premium features, provide a valid payment method
• accept and comply with the ToS

The Service is available in multiple tiers with varying features and usage limitations as detailed on our website. Service tiers may include both free and premium options with different levels of access to AI features, storage capacity, and service usage limits.

3.3 Technical Requirements

To utilize the Service, the User must use an electronic device capable of accessing the platform. Pathleader reserves the right to modify technical requirements, adjust available payment methods, and to change, add, or remove features from the Service.

4.1 Pricing

Current pricing for Premium Service tiers are displayed on the pathleader.ai website and may include monthly and annual subscription options.

4.2 Free Service

Free Service options may be available with usage limitations as specified on our website.

4.3 Price Changes

Pathleader reserves the right to adjust pricing by providing prior notice to Users. Price changes will take effect after notice has been provided at least thirty (30) days in advance. Continued use of Premium Service after such notice shall constitute acceptance of the new pricing.

5.1 Pathleader's IP Rights

All intellectual property rights relating to the Service and its content, including trademarks, service marks, trade dress, domain names, patents, inventions, trade secrets, copyrights, database rights, and all other intellectual or industrial property rights belong exclusively to Pathleader or its licensors.

5.2 Limited License

No rights, licenses, or ownership interests in or to the Service are transferred to the User under this ToS. The User is granted only a limited license to use the Service as specified herein.

6.1 License Grant

Subject to compliance with this ToS and payment of applicable fees, Pathleader grants the User a limited, revocable, non-exclusive, non-sublicensable, non-transferable license to access the Service solely for personal, non-commercial use.

6.2 Prohibited Activities

The User acknowledges and agrees not to:

• copy, reproduce, duplicate, modify, adapt, sell, rent, lease, loan, sublicense, or otherwise exploit parts or the entirety of the Service
• redistribute, decompile, reverse engineer, disassemble or otherwise reduce any Service to a human-readable form
• remove any identification, copyright or other proprietary notices
• access or use the Service in an unlawful or unauthorized manner
• use the Service to compete with Pathleader or develop competing services

7.1 AI Services

The Service utilizes artificial intelligence to:

• Analyze User CVs and job preferences for matching purposes
• Generate personalized cover letters and career advice
• Provide interview preparation assistance
• Deliver relevant job recommendations

7.3 User Verification

The User acknowledges that AI-generated content should be reviewed and may require User verification before use in professional contexts.

7.4 AI Content Disclaimer

Pathleader endeavors to ensure AI communications are accurate and unbiased but assumes no responsibility for AI-generated content that may be perceived as discriminatory, offensive, or inappropriate.

8.1 Third-Party Integrations

The Service integrates with various third-party job boards, employment services, and career-related platforms to provide comprehensive job search functionality.

8.2 Third-Party Content Disclaimer

Pathleader is not responsible for the accuracy, availability, or content of third-party job listings or services.

8.3 Employer Relationships

Job applications and communications with potential employers occur directly between the User and such employers. Pathleader is not party to these relationships.

8.4 Third-Party Terms

Third-party services are subject to their own terms of service and privacy policies.

9.1 User Responsibilities

The User is responsible for:

• Providing accurate and up-to-date information in CVs and profiles
• Maintaining the security of their account credentials
• Using the Service in compliance with applicable laws and regulations
• Reviewing and verifying AI-generated content before professional use

9.2 Prohibited Conduct

The User may not:

• Share account access with others
• Use the Service for unlawful or fraudulent purposes
• Upload malicious software or content
• Violate any applicable employment laws or regulations
• Use the Service to spam or harass potential employers

10.1 User Termination

The User may terminate their account at any time. For Premium accounts, termination becomes effective at the end of the current billing period.

10.2 Pathleader Termination Rights

Pathleader may terminate User accounts immediately for:

• Violation of this ToS
• Fraudulent or abusive behavior
• Non-payment of Premium fees
• Any activity that may harm Pathleader or other Users

10.3 Data Handling

Upon termination, all User data will be handled according to the Privacy Policy, including User rights to data deletion.

11.1 Service Availability

Pathleader aims to provide reliable Service availability but does not guarantee uninterrupted access. Pathleader may temporarily suspend Service for maintenance, upgrades, or technical issues.

11.2 Service Modifications

Pathleader may modify the Service, including adding or removing features, with reasonable notice to Users.

11.3 Assignment of Rights

Pathleader may assign its rights and obligations under this ToS to third parties, with notice to Users regarding any changes affecting personal data processing.

11.4 Terms Updates

Substantial changes to this ToS will be communicated at least thirty (30) days in advance via email or Service notifications.

12.2 AI Limitations

AI-generated content may contain errors, biases, or inaccuracies. Users must exercise judgment when using AI-generated materials professionally.

12.3 Liability Limitation

Pathleader's total liability for all claims shall not exceed the amount paid by the User during the twelve months preceding the claim. Pathleader shall not be liable for indirect, incidental, or consequential damages.

12.4 Force Majeure

Pathleader is not liable for service interruptions due to circumstances beyond its control, including but not limited to natural disasters, government actions, or third-party service failures.

13.1 Privacy Policy Integration

Processing of personal data is governed by the Pathleader Privacy Policy, which forms an integral part of this agreement.

13.2 User Rights

Users have rights regarding their personal data as specified in the Privacy Policy and applicable data protection laws.

13.3 International Transfers

International data transfers are conducted with appropriate safeguards as detailed in the Privacy Policy.

14.1 Governing Law

This ToS is governed by Swedish law, without prejudice to mandatory consumer protection laws in the User's country of residence.

14.2 Dispute Resolution Process

Disputes shall first be addressed through good faith negotiations. If unresolved, disputes may be submitted to:

• The National Board for Consumer Disputes (Allmänna Reklamationsnämnden - ARN) for consumer disputes
• Swedish general courts for other disputes

14.3 Consumer Rights

Users may also have rights to dispute resolution in their country of residence under applicable consumer protection laws.

15.1 Entire Agreement

This ToS and the Privacy Policy constitute the entire agreement between the parties.

15.2 Severability

If any provision of this ToS is found invalid, the remaining provisions shall remain in effect.

15.3 Waiver

Pathleader's failure to enforce any provision does not constitute a waiver of such provision.

15.4 Updates

This ToS may be updated from time to time, with notice provided as specified herein.
